By accessing, downloading, or using the Services, you agree to comply with these Terms and Conditions, as well as our Privacy Policy, incorporated herein by reference.
2. User Responsibilities
- • You represent that you are of legal age and have the authority to enter into this agreement, either individually or on behalf of an organization.
- • You agree to use the Services only for lawful purposes and in compliance with all applicable laws and regulations.
- • You will not upload data containing sensitive or personally identifiable information (PII), unless explicitly permitted by law.
3. Use of Services
3.1 Data Upload and Analysis
Users may upload datasets in CSV or Excel formats for analysis. The Services use browser-based Python execution and configurations generated by ChatGPT to process these datasets. Analysis results are advisory and should not be relied upon for critical decisions without further validation.
3.2 Free Trial Data Usage
For free-tier users, datasets may be anonymized and used by the Company to improve the Services.
3.3 Restrictions
- Reverse-engineer, decompile, or otherwise attempt to discover the source code.
- Use the Services for benchmarking or competitive analysis.
- Circumvent any restrictions, security measures, or usage limits.
4. Data Security and Privacy
User data is stored in secure AWS S3 instances. While we implement reasonable security measures, we are not liable for data breaches or losses resulting from AWS infrastructure issues. By using the Services, you consent to the storage and processing of your data as outlined in our Privacy Policy.
4.1 Data Processing for EU Users
If you are located in the European Economic Area (EEA), your personal data may be processed outside the EEA, including in the United States. To ensure compliance with the General Data Protection Regulation (GDPR), we rely on Standard Contractual Clauses (SCCs) to safeguard your data.
5. Intellectual Property
All rights, title, and interest in the Services, including underlying technology and methodologies, remain the exclusive property of IDARE. Any feedback provided by you may be used by IDARE to improve its offerings without compensation.
6. Client Listing
By using the Services, you agree that your company name may be listed publicly as a client of IDARE, unless otherwise prohibited by law or agreed upon in writing.
7. Disclaimers
The Services are provided "AS IS" without warranties of any kind. We disclaim all warranties, including merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee uninterrupted access or that the Services will be free from errors.
8. Limitation of Liability
To the fullest extent permitted by law, our liability is limited to the amount paid by you in the 12 months preceding the claim or $200, whichever is greater. We are not liable for indirect, incidental, or consequential damages.
9. Modifications to Terms
We reserve the right to modify these Terms and Conditions at any time. Continued use of the Services constitutes acceptance of the updated terms.
10. Termination
We may terminate your access to the Services for any breach of these Terms or at our sole discretion. Upon termination, you must cease using the Services.
11. Governing Law
These Terms and Conditions are governed by the laws of the State of Texas, USA. Any disputes will be resolved exclusively in the courts located in Houston, Texas.
